Adrian D’Arcy and Ashley Robinson Presented a Seminar at the New Orleans Bar Association’s 2024 Procrastinators Program

Adrian D’Arcy and Ashley Robinson spoke again at this year’s New Orleans Bar Association’s Procrastinators Program.

 

 

 

 

 

Adrian and Ashley discussed recent Louisiana cases in the field of construction and surety law and the possible import of these decisions to legal practitioners. Specifically, Adrian and Ashley spoke about a recent Louisiana Supreme Court decision which provided clarity on the issue of third-party demands and the exception of prematurity and a Louisiana Supreme Court decision on an architect/designer’s liability for project safety. Adrian and Ashley also discussed an interesting Louisiana appellate decision regarding perememption and arbitration, the increased enforcement of conditions precedent in surety performance bonds by Louisiana courts, legislative changes which overrule longstanding caselaw, and ongoing litigation regarding mandamus versus ordinary proceedings arising out of the Louisiana Public Works Act.
